Lahore High Court Decision About 50, 50 % Quota System For MBBS & BDS Admission in Medical & Dental Colleges
Lahore High Court has declared the 50, 50 quota system null and void for admission in medical and dental colleges. Now admissions in MBBS and BDS will be granted on open merit basis basis. Still UHS, PMDC and affected students have two options. Either they can go for revision in High Court or Appeal in Supreme Court. But presently quota system has been declared against the article 25 of constitution by Honorable Lahore High Court. Justice Ayesha A Malik declared that discrimination with females can not be allowed and females who want to excel in life with hard work should not be discouraged. In a moderate society females are given opportunities for progress. PMDC, UHS and ministry of health failed to convince the honorable court about the logic and utility of their decision.

Lawyer of PMDC argued that according to their study report majority of female doctors do not continue their medical profession after their marriages. He admitted in court that quota policy was introduce to increase the ratio of male students in the medical and dental colleges. According to him Pakistan is patient doctor ratio in Pakistan is worse in the region. Pakistan needs doctors who stay in profession and open merit policy has become a cause of wastage of national resources.

On the other hand lawyer of Asma, Sadia and other female students Malik Ghulam Rasul advocate argued that quota system is the violation of constitution of Pakistan as all the citizen are equal and 50, 50 policy is discriminatory towards female students. PMDC and HEC introduced this policy secretly on 18 September 2014 just five days before the last date for submission of forms in medical and dental colleges. Now female students with 93% marks will not be able to get admission in medical colleges.

After hearing the arguments from both sides court declared that prima facie quota system is against the article 25 of constitution and reinstated the open merit policy. Situation will be clear in couple of days as if no one will go for revision or appeal then open merit policy will continue.  Decision of provincial High Court is binding for all medical and dental colleges of Punjab only.
